Verification of the inability to earn by the employer
During the period of incapacity for work, in the case of an employee, the employer, in the
case of a public employee, the public employer or the state employment agency is entitled
to initiate a review of the incapacity for work at the government office.
In the case of initiating a review of the earning capacity, the name, place and time of birth,
address, mother's name, social security identification number and the beginning of the
incapacity for work must be provided.
The application must include the name, address, tax number of the employer or public
employer, the name of the person authorized to sign, as well as their telephone and postal
contact information.
An administrative service fee of HUF 15,800 must be paid for the employer's initiation of the
review of the employee's inability to earn.
At the request of the employer, the expert chief physician decides on the insured's inability
to earn or his earning capacity based on the data found in the patient documentation or, in
justified cases, on the basis of the examination of the incapacitated insured.
After the decision, the employer and the employee are notified in writing, and the decision is
entered in the Medical Diary.
Against the decision, the employee and the employer may initiate a medical review at the
government office acting as a medical expert within 8 days from the notification.
The same government office cannot act during the assessment of the review. The
government office takes care of forwarding the review request.
