Tax refund for diesel used in agriculture

The Minister of Agriculture announced that the government will help farmers with another measure, as it was recorded in a government decree that as of May 1, the amount of tax that can be reclaimed for diesel fuel used in agriculture will rise to 90 percent.

István Nagy decided to increase the rate of excise tax reimbursement as one of the elements of his five-point package of measures aimed at improving the situation of the grain sector.

According to the previous regulations, depending on the world market price, 86 and 87 percent of the tax paid for diesel used in agriculture could be reclaimed. Now this is raised to 90 and 90.5 percent, which means an average HUF 400 surplus per hectare for farmers. Also, when reclaiming the excise tax on diesel fuel used in agriculture, the amount of diesel fuel that can be accounted for can still be a maximum of 97 liters per hectare per year.

Common procedural rules for excise tax refunds:

From when can the excise tax be claimed back?

  • annually (from the 20th day of January of the year following the current year at the earliest),

  • quarterly (from the 20th day of the month following the relevant quarter at the earliest),

  • monthly (from the 20th day of the month following the relevant month at the earliest)

 What is the deadline for validating the refund?

  • 5 years.

What are the general conditions for a refund?

  • existence of an accounting document issued for the purchase of an excise product at a price including excise tax

  • tax calculated at the tax rate in effect on the date of issuance of the purchase receipt can be taken into account

  • from the consideration on the receipt, at least the tax content calculated at the tax rate in force on the day of issue must be equalized

  • in relation to transport, a tax refund can be claimed for diesel fuel that does not contain a marker

  • proof of claim entitlement
